1. Acceptance of Terms

By creating an account, accessing, or using Anesthesia Breaks Pro ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

gavel Strict Prohibition of Protected Health Information (PHI)

This is the most critical operational constraint of the Service.You, the User, explicitly acknowledge that Anesthesia Breaks Pro is an operational routing matrix. It is NOT a HIPAA-covered entity, a Business Associate, nor an Electronic Medical Record (EMR) system.You agree that you will NEVER enter, upload, or otherwise transmit Protected Health Information (PHI) into this system. PHI includes names, dates of birth, social security numbers, medical record numbers, specific diagnoses, surgical CPT codes, or any other identifier capable of tying a clinical procedure to a specific individual.Entering PHI into Anesthesia Breaks Pro constitutes a direct breach of these Terms and may expose your facility to federal HIPAA violations. We bear zero liability for unauthorized PHI transmission committed by Users.

2. Account Registration and Security

Users must provide accurate, complete, and current registration information. Anesthesia Breaks Pro mandates the use of Multi-Factor Authentication (MFA), including Passkeys (Biometrics) or TOTP Authenticator applications, for all active clinical accounts. You are exclusively responsible for safeguarding the credentials and authenticated devices you use to access the Service.

Any activities or actions under your account are your responsibility. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Limitation of Liability and Indemnification

In no event shall Anesthesia Breaks Pro, its developers, or its affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, administrative fines, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Unauthorized access, use, or alteration of your transmissions or operational content.
  • Federal or State regulatory fines incurred due to your transmission of prohibited clinical data (PHI).

You agree to defend, indemnify, and hold harmless Anesthesia Breaks Pro from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your violation of these Terms or your transmission of restricted patient data.

4. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
